Yes, Iranian citizens are eligible to apply for an EB-5 Visa. On October 22, 2012, the Department of the Treasury Office of Foreign Assets Control (“OFAC”) issued regulations (called a “general license” in OFAC parlance) which state that United States persons and entities can engage in all transactions necessary to export financial services to Iran in connection with the EB-5 visa, provided that the transfer is effected in accordance with all U.S. laws and regulations. Further, in the event that an EB-5 visa application is denied, withdrawn, or otherwise does not result in the issuance of an EB-5 visa, U.S. persons and entities are authorized to transfer, in a lump sum back to Iran or to a third country, any funds belonging to the EB-5 visa applicant that are held in an escrow account during the pendency of, and in connection with, such EB-5 visa application.
