First, there is no predictability as to processing times and no consistency with certain types of projects leading to faster processing times. Second an experienced EB-5 attorney preparing a I-526 petition may lead to a shorter processing time. For instance, our law office obtained an approval of a I-526 petition within 2 months, however we can not state all I-526 petitions will be processed with the same time period. Every type of EB-5 project will have to be analyzed so that an experienced EB-5 attorney can advise you of the quickest time for processing.
USCIS processing times are set by USCIS and are only estimates. USCIS does not distinguish direct EB-5 investments from Regional Center investments (they list the times by form number: I-526). Currently USCIS last processed cases from March of 2012 (nearly 18 months ago). By retaining qualified and experienced US Immigration counsel, like the attorneys at our law firm, we can assist you with an approvable US Immigration plan.
