Choosing a law firm is an important step in achieving your U.S. Immigration goals. Emailing or calling law firms who specialize in U.S. Immigration law and exclusively practice U.S. Immigration law, as our law firm does, and arranging consultations is extremely helpful. Experience counts, and the lawyers at our law firm have the experience in EB-5, H-1B, and many other processes that can help you and your son.
You are staring in the middle. The NUMBER ONE concern is finding an employer who is willing to file a petition on his behalf. That is unlikely to happen for a new graduate who is NOT graduating from a U.S. University. He might be better off continuing his education in the U.S. and then try for an H1-B following OPT/CPT employment Or apply for an EB-2 immigrant visa (perhaps simultaneously with the H1-B petition). You need (or rather, your son needs) to have a sit down discussion with an immigration professional.
Our law firm has experience representing clients in the H1 B process. However, before you start the H1 B process you need to discuss with an experienced EB-5 attorney who also has H1 B experience, an analysis of the timeline and the difference between the two approaches. Please note the H1B process is a non- immigrant process compared to the EB-5 process which is an immigrant process.
