Yes, the US Attorney General has the authority to raise the minimum EB-5 investment threshold at any time. Investment in a Regional Center or qualifying TEA will remain set at 50% of the minimum investment in a non-TEA (ie $1 million) project. Thus, if the minimum EB-5 investment is raised to $1.5 million, the minimum TEA or Regional Center will rise to $750,000.
It should be noted that investors are not limited to the $500,000 investment level. While they must meet the minimum requirement they are free, subject to the approval of the regional center, to investment more if they like the deal.
The minimum investment amount is currently one-million dollars. The minimum has been adjusted downward to the lowest amount allowed under the law BUT only in a qualified Targeted Employment Area (TEA). The mere fact that one is investing through a Regional Center does not affect the statutory minimum amount. The Regional Center project might be in a TEA and the lower amount may be available but based on the project being in a TEA rather than being through a Regional Center. The fact that a project is affiliated with a Regional Center allows the added advantage of using "indirect jobs" but has NO bearing on the minimum investment amount. The TEA minimum is $500,000.
