In this article, noted attorney Stephen Yale-Loehr discusses two memos issued by the United States Citizenship and Immigration Services (USCIS) conerning the US EB5 immigrant investor visa program. In particular, the June 12 and June 17 EB-5 Memos written by Acting Associate Director for Domestic Operations Donald Neufeld.
The June 12 memo responds to EB5 visa recommendations issued by the USCIS's office of the ombudsman. The second and more important one for the EB5 visa program was issued on June 17 and addresses many technical points concerning EB5 visa job creation, when jobs must be created, proof of job creation at the I-829 submission to remove conditions, and further defines full time jobs under the EB5 visa program. This article addresses many of the areas of concern for the EB5 immigrant investor visa practioner, their clients and project managers and is a great guide to ongoing issues of practice withing the EB-5 program.
