Klausner Lumber One filed a motion on July 19 to dismiss the complaint filed against them by former employee Emma Tirella.
The dismissal says Tirella failed to state a claim for relief or plead her claims with enough particular detail.
“The convoluted complaint contains a litany of grievances, most of which occurred prior to her employment and are derived from 72 pages of public records predating Tirella's employment…” the document states.
It continues to say that Tirella was not in a position to have personal knowledge of her allegations.
Tirella is suing the lumber company for submitting false statements to the federal, state and local governments to receive public grants and funding.
According to court documents, the former human resources generalist witnessed systemic fraud within the Austrian company.
