This decision is to one of six investors who were involved in the development of a 12-bed in-patient facility and the provision of in-home care to terminally ill patients. This group was NOT affiliated with a Regional Center (RC) but was trying to act like one. They established a new commercial enterprise (NCE) for the sole purpose of making a LOAN to the developer of the job-creating entity (JCE) "hospice" business. The plan sought to utilized indirect jobs. Only a USCIS-Designated RC is allowed to utilize indirect jobs. The investor sought approval based on an amended business plan and investment structure. Due to the critical importance of the Filing Date of the I-526 visa petition, no material changes are permitted. To allow material changes to substandard filings would give an unfair advantage to someone who was not eligible at time of filing.
