The EB-5 Investment Visa program will sunset on 30 September 2015. Whether it actually does expire or whether it is revised or otherwise amended, the program as it now exists will undergo some measure of change. Of the options available to Congress, simply renewing the program as is, is the most unlikely to happen, especially with immigration reform in general being the hot topic that it is.
The American Job Creation and Investment Promotion Reform Act (Senate Bill 1501) is almost certain to be approved, albeit with modifications to its original submission.
The worst-case scenario of the program expiring means that investors considering immigration under EB-5 should move now to ensure inclusion before time runs out.
On the upside, should the bill be passed into law, there is an excellent chance that some country visa limits – certainly China’s – may be significantly increased. However, it is just as likely that Congress will also authorize as much as a 60% increase in the minimum EB-5 investment – another reason why acting sooner rather than later may be a wise decision for investors.
