Sometimes people cry "foul" due to Ineffective Assistance of Cousel (IAC). In the benefits context, even if this does happen, and even if you convince an agency that some "procedural" problem was the fault of an incompetent representative and they grant relief, that relief has severe limits. An unqualified, ineligible, or undeserving petitioner or applicant CANNOT be granted a benefits that they are not enetitled to as a form of "relief". It ain't gonna happen! So, when one is successful in such a claim, they then still have to prove eligibility!
